Showing in Lake Forest
This afternoon I showed friends-turned-clients a home in Lake Forest. Built in 1997, is is situated on a large corner lot with mature landscaping. The home features a split bedroom floorplan and an additional suite upstairs, complete with a mini-kitchen area.
This morning I attended the full building inspection of my buyers’ possible new home. The inspector was thorough and professional. We received the printed report before we left the property. My buyers were realistic, and the sellers were responsive. A win-win.
Included and Excluded Personal Property
Tonight I had a four hour go-round with a listing agent regarding…..curtains. “Draperies” as they are referred to in Paragragh 1, Line 18 of the Florida Realtors/Florida Bar As-Is Contract for Residential Sale and Purchase, are listed as in included in the purchase. My buyers liked and needed the curtains so, that I even typed in “window treatments and curtains” to make certain their intentions were clear. The situation is now resolved, however I am motivated to write about the sales contract and typical included and excluded items.
The old example we used previously was “turn the house upside down. Everything that falls out goes with the seller. Everything attached stays. For example, a built in microwave stays and a free standing counter top microwave goes. However, the contract states included items are: range(s)/oven(s), refrigerator(s), dishwasher(s), disposal, ceiling fan(s), intercom, light fixture(s), drapery rods and draperies, blinds, window treatments, smoke detector(s), garage door opener(s), security gate and other access devices, and storm shutters/panels. And to complicate matters further, the real estate attorney I spoke to today stated wall mounted TVs and mounts can go either way. It depends on if the “fixture” was intended for permanent installation, or temporary.
Bottom line, if you are the seller and plan to take anything with you that is currently attached to a wall, ceiling, floor, window, fence – EXCLUDE the item(s) on the sales contract. If you are a buyer and you expect anything in the house to stay (washer and dryer, garage refrigerator, TV mount(s), trampoline, pool equipment – INCLUDE it in the sales contract.
Today my clients secured a contract on a beautiful Lake Forest home. This 4 bedroom, 3 1/2 bath home sits on expansive lot with manicured landscaping.
